Terms and Conditions – FOS Travel

1. Introduction & Acceptance of Terms

  • Agreement: Welcome to FOS Travel (the "Website"). By accessing, browsing, or registering for our travel club, you agree to comply with and be bound by these Terms and Conditions ("Terms").

  • Eligibility: You must be at least 18 years of age and possess the legal authority to enter into this agreement to use our services and book travel through FOS Travel.

  • Updates: We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Website, and your continued use constitutes acceptance of those changes.

2. Membership Fees, Billing, & Renewal

  • Annual Membership Fee: The annual membership fee for FOS Travel is $299 USD (plus any applicable local taxes). This fee grants you access to club-exclusive travel rates, perks, and booking privileges for one year.

  • Automatic Renewal: To ensure uninterrupted access to your benefits, your FOS Travel membership will automatically renew every year on your anniversary date.

  • Payment Authorization: By providing your payment details, you authorize FOS Travel to automatically charge the then-current annual renewal fee ($299) to your payment method on file, unless you cancel prior to the renewal date.

  • Cancellation & Refund Policy: You may cancel your FOS Travel membership at any time through your account dashboard or by contacting our support team. Cancellations will take effect at the end of your current billing period. Membership fees are non-refundable, and partial refunds or credits will not be issued for unused portions of a membership year, except where required by law.

  • Price Changes: FOS Travel reserves the right to adjust membership pricing. Any price changes for upcoming renewal terms will be communicated to members via email at least 30 days prior to taking effect.

3. Travel Bookings & Third-Party Suppliers

  • Role as Intermediary: FOS Travel acts as an intermediary connecting members with third-party travel suppliers, including airlines, hotels, cruise lines, tour operators, and car rental companies.

  • Supplier Terms: Your bookings are subject to the specific terms, conditions, and cancellation policies of the respective third-party suppliers. FOS Travel is not responsible for the acts, omissions, errors, or service failures of any third-party suppliers.

  • Pricing & Availability: All travel prices, itineraries, and availability featured on FOS Travel are subject to change without notice until a booking is fully confirmed and paid for.

4. Member Conduct & Responsibilities

  • Accurate Information: You agree to provide accurate, current, and complete information during registration and booking, including correct legal names matching government-issued identification.

  • Travel Documents: Members are solely responsible for obtaining all required travel documents, including valid passports, visas, health/vaccination certificates, and meeting any entry requirements for their destinations.

  • Prohibited Behavior: FOS Travel memberships are strictly personal. Members agree not to share account credentials with non-members, resell club-exclusive rates, or engage in fraudulent, abusive, or disruptive behavior on the platform.

5. Limitation of Liability

  • Disclaimer: The Website and its contents are provided on an "as is" basis. FOS Travel disclaims all warranties, express or implied, regarding the accuracy, safety, or reliability of travel listings provided by third parties.

  • Limitation: To the maximum extent permitted by law, FOS Travel shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of your travel experiences, supplier failures, flight delays, or use of the Website.

6. Governing Law & Dispute Resolution

  • Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles.

  • Dispute Resolution: Any legal disputes, claims, or controversies arising from these Terms, your FOS Travel membership, or bookings made through the platform shall be brought exclusively in the state or federal courts located in Bay County, Florida.
